Acceptance of terms

Rocketspark Ltd (“Rocketspark”) facilitates the establishment of an online store and hosts the online store as part of Rocketspark’s webhosting service (“online store services”).

These Special Terms and Conditions for online stores (“Special Terms”) govern all supply of goods and services related to the provision of online store services by Rocketspark. These terms are additional to Rocketspark Ltd’s standard terms and conditions, including provisions of those terms and conditions relating to Bad or Objectionable conduct and Bad behaviour [link].

By acquiring online store services from Rocketspark and/or by clicking the “I accept” link upon registration, you indicate your continuing acceptance of these online store Special Terms.

Your responsibilities

You are entirely responsible for all aspects of the goods and services that you supply and for all aspects of the trading relationship you have with your customers and prospective customers. You must:

  • Comply with all laws in the countries in which you operate your online store, in all countries into which you are selling or offering products for sale;
  • Ensure all information on your website, including all product information, is complete and accurate including information about product availability;
  • Ensure you are able to give good title to purchasers of products from you;
  • Ensure that that you are entitled to sell the products and services you are offering;
  • Ensure you have rights to all content you display on your website including all relevant intellectual property rights;
  • Ensure your use of customer information complies with the privacy laws in all countries into which you sell products, and all countries in which you operate or carry on business and ensure that at all times you include on your website an appropriate privacy policy;
  • Fulfil customer orders within a reasonable timeframe and resolve any customer complaints directly with the customer without involving Rocketspark;
  • Ensure the invoices that you provide to customers are accurate;
  • Ensure the accuracy of all information in all documents issued by you including all freight documents and invoices, including ensuring their accuracy for tax purposes in your country;
  • Ensure that you have a warranty for all products, and terms of sale together with a returns and refunds policy that complies with the law in your country and in all countries into which you are selling or offering products for sale.

You are responsible for obtaining your own independent legal advice about all aspects of your business.

PayPal

Rocketspark facilitates the simple integration of PayPal’s trusted payment solutions into your on-line store so that your customers can pay you. We provide some general guidelines for setting up your PayPal account but the relationship for payments services exists between you and PayPal and you must agree to PayPal’s own terms and conditions when setting up your account.

Rocketspark assumes no responsibility for any issues you have with PayPal and while we may assist you with fault diagnosis (for example and where possible, by providing standard information generated by our systems) we will not be obliged to do so and any payments disputes or issues must be pursued by you directly with PayPal.

Rocketspark is not an agent of Paypal and Rocketspark has no involvement with PayPal transactions.

PayPal charges a fee per transaction and the fee is deducted from sale proceeds. Full details of PayPal’s fees can be found here. Prices may vary by country.

Limits of Rocketspark’s online store services

Rocketspark does not participate in any way as principal, agent, representative or in any other capacity whatsoever in any sales transactions that may be attempted or carried out using an online store facilitated or hosted by Rocketspark.

Any model contractual terms or policies, which may include privacy policies or model terms of trade, are provided by Rocketspark for your general information only, and must not be relied on as legal advice. Rocketspark does not warrant that these model documents are fit for the purposes of your business. You have no authority to Act as agent of Rocketspark. The only relationship between you and Rocketspark is that Rocketspark provides services to you under a contract. Rocketspark’s services are limited to supplies of online tools and services for design of your website, and hosting services your websites.

Warranty and indemnity

By acquiring services covered by these Special Terms and conditions from Rocketspark, or by continuing to permit Rocketspark to host your website, you warrant and continue to warrant that you have complied with all of “Your responsibilities” as set out above.

You indemnify Rocketspark and its agents against all claims, costs or losses of any kind whatsoever (including legal costs on a solicitor-client basis) arising from:

  • your failure to comply with these Special Terms and Conditions including your breach of any warranty; or
  • your failure to comply with the laws of any country; or
  • your failure to comply with the Rocketspark Ltd Terms and Conditions; or
  • claims made by third parties (including PayPal) relating to any of your websites.
